Internal Revenue Service (IRS): Federal Taxes

Dallas County Tax Office: Local Taxes
The Dallas County Tax Office collects property taxes and vehicle registration fees for Dallas County; it does not administer income, sales, or franchise tax. J. A federal tax lien is the government’s legal claim against a taxpayer’s property, and it arises automatically once the IRS assesses a tax, sends a demand for payment, and the balance goes unpaid. The IRS generally files the public Notice of Federal Tax Lien when the balance reaches $10,000; the filing attaches to real estate, vehicles, and business assets and appears in public records and title searches. A lien is not a seizure: the IRS seizes property through a levy, and in most cases only after a Final Notice of Intent to Levy (Letter 1058 or LT11) and a 30-day window to request a Collection Due Process hearing.
J. David Tax Law’s Dallas tax attorneys resolve an IRS tax lien through one of four remedies: release, which the IRS issues within 30 days of full payment; withdrawal, available on direct debit installment agreements with balances of $25,000 or less; subordination, which lets a lender refinance ahead of the IRS; and discharge, which removes the lien from a specific property so it can be sold. Where the balance cannot be paid, our attorneys secure Currently Not Collectible status or settle the debt through an installment agreement or offer in compromise. When the IRS has issued a Final Notice of Intent to Levy, we file the Collection Due Process appeal, which stops the seizure while the case is heard, and negotiate alternatives when the IRS proposes a voluntary sale of assets.
Bankruptcy discharges federal income tax debt only when the return was due more than three years before the bankruptcy filing, the return was filed at least two years before it, and the tax was assessed at least 240 days before it, with no fraud or willful evasion. Tax debt from unfiled returns, payroll and trust fund taxes, and tax years inside that three-year window survive a Chapter 7 discharge, and a Notice of Federal Tax Lien filed before the bankruptcy stays attached to property the taxpayer already owned. A Chapter 7 case remains on a credit report for 10 years and a Chapter 13 for seven. In 2024, over 517,000 bankruptcy cases were filed in the U.S., a 14.2% increase over 2023. J. David Tax Law resolves tax debt through IRS installment agreements, offers in compromise, penalty abatement, and Currently Not Collectible status, none of which requires a bankruptcy filing.

An IRS audit begins with a notice that names the tax years under examination and the format: a correspondence audit by mail, an office audit at an IRS office, or a field audit at your home or business. Our Dallas tax attorneys review the returns and records for the years listed and assemble the documentation that answers each item on the examiner’s Information Document Request (IDR) before the examiner sees any of it.
Resolution strategy starts with your financial record: income, assets, and reasonable collection potential, the figure the IRS uses to accept or reject an offer in compromise. That analysis determines whether a balance assessed after the audit fits an offer in compromise, an installment agreement, or Currently Not Collectible status, and it decides which proposed adjustments are worth contesting.
A licensed tax attorney speaks to the examiner for you. With Form 2848 on file, the IRS sends notices and IDRs to your attorney, and our attorneys attend office and field interviews in your place, so no statement of yours enters the examination record. Every response is filed before the deadline printed on the notice, because a missed deadline lets the IRS assess the tax by default.
The examination closes with an examination report (Form 4549) and a 30-day letter, which opens the window to appeal to the IRS Independent Office of Appeals. If Appeals does not resolve the case, the IRS issues a Notice of Deficiency, and you have 90 days to petition the U.S. Tax Court, which holds trial sessions in Dallas. Our attorneys file the protest, negotiate with Appeals, and prepare and litigate the Tax Court petition.
The accuracy-related penalty under IRC §6662 adds 20% of any underpayment the IRS attributes to negligence or a substantial understatement, and interest accrues on the tax and the penalty. Our attorneys contest the penalty for reasonable cause and resolve any remaining balance through an installment agreement, offer in compromise, or Currently Not Collectible status, so the audit ends with a closed account rather than a new collection case.

To reduce tax debt in Dallas, a taxpayer uses one of four IRS programs: an installment agreement, which spreads balances of $50,000 or less over up to 72 months under the streamlined rules; an offer in compromise, which settles the debt for less than the balance when the IRS agrees your reasonable collection potential is lower; Currently Not Collectible status, which pauses collection while your income covers only allowable living expenses; and penalty abatement, which removes failure-to-file and failure-to-pay penalties under the first-time or reasonable-cause rules. Yes. A taxpayer can negotiate with the IRS directly, and the IRS accepts installment agreement requests and offers in compromise filed without a representative. A tax attorney adds two things: attorney-client privilege, which keeps your communications confidential even if the case turns criminal, and representation that continues into the U.S. Tax Court if the IRS issues a Notice of Deficiency. Representation changes the outcome most when the balance is large, returns are unfiled, a levy or wage garnishment is active, or an IRS criminal investigator has made contact.
An offer in compromise stops new IRS levies but does not itself release an existing garnishment or lien. Under IRC §6331(k), the IRS may not levy while an offer is pending, for 30 days after a rejection, and during an appeal of that rejection. A wage garnishment already in place must be released separately, which our attorneys request at the same time as the offer, and a filed Notice of Federal Tax Lien stays in place until the accepted offer is paid, after which the IRS releases it within 30 days.
The Texas Comptroller of Public Accounts collects unpaid sales, use, and franchise tax through audits, state tax liens, bank account freezes, and, for businesses, revocation of the sales tax permit and forfeiture of the right to do business in Texas. The Comptroller adds a 5% penalty to a late payment, 10% once the balance is more than 30 days late, plus interest at the prime rate plus 1%, and it has four years from the due date to assess most taxes. A taxpayer has 60 days from a Notice of Determination to request a redetermination hearing. J.
